Terms and Conditions

1. Renter Information

Primary renter is 18 years old or more, above the age of majority in the province of Ontario. Each renter is assumed to have the physical abilities to use the equipment rented.

 

2. Rental Details

Rentals can comprise of watercraft including but not limited to kayaks, stand up paddle (SUP) boards, canoes, and rafts; and beach gear such as chairs, umbrellas, canopies, games, and blankets. Mandatory safety equipment, as per transport Canada, will be included. Rentals will be based on hourly or daily schedules. Rentals will only operate from the Silver Gull Outdoors location at 450 Brock street at Gull Lake Rotary Park Gravenhurst, Ontario.

3. Assumption of Risk and Liability Waiver

All renters over 18 years old MUST read, understand and sign the assumption of risk and waiver of Liability. All minors MUST have parents or legal guardians sign on their behalf. Electronic signatures are accepted as official signatures.

 

4. Renter Responsibilities

Renter agrees to:

  • properly wear a fitted Transport Canada/ Canadian Coast Guard approved personal flotation device (PFD) at all times while using the rental watercraft.

  • all zippers/ buckles must be secured and straps tightened snugly around the person wearing the pfd.

  • operate watercraft in a safe, lawful, and respectful manner.

  • carry Equipment to and from the water.

  • store stand up paddle boards topside down/ fin side up while on land

  • not be under the influence of alcohol or drugs for the duration of the rental.

  • return all Equipment in the same condition as received (excluding reasonable wear and tear).

  • notify the Company immediately of any incidents or damage.

  • pay for any damages, loss, or theft of Equipment. Replacement or recovery fees may apply.

  • be respectful of private properties accessible by water and associated no trespassing laws.

  • only allow registered renters with signed waivers to use the equipment.

  • stay in the Gravenhurst rental area including Gull lake, Silver Lake, and the HocRoc river.

  • return to shore in unsafe weather conditions (thunder and lightning or high winds)

 

5. Cancellation & Refund Policy

Cancellations made at least 24 hours before the rental time will receive a full refund. Cancellations determined by the company can re-book or receive a full refund- No refunds for same-day cancellations or early returns due to weather or personal reasons, unless otherwise agreed by the Company.

 

6. Late Return Policy

A late fee of $50 an hour may apply for Equipment returned past the agreed return time. After 3 hours late, or 1 hour after the final rental time of the day, whichever comes first, the Equipment may be considered stolen, and authorities may be contacted.

 

7. Inspection and Damage- Renter agrees to inspect Equipment before use and notify Company of any pre-existing damage or concerns. - Company will inspect Equipment upon return; any new damage will be assessed and may be charged to the Renter.

 

8. Governing Law

This Agreement shall be governed by and construed in accordance with the federal laws of Canada, Provincial laws of Ontario and municipal laws of both the District of Muskoka and the Town of Gravenhurst.

9. Acknowledgment

By booking experiences or renting from Silver Gull Outdoors directly, through partners or online the Renter acknowledges that they have read, understood, and agreed to all terms and conditions outlined in this Agreement.
